Like Kind
Just about any type of real property qualifies as like kind. The only type of property that does not qualify is personal property. In an exchange the type of property being exchanged must have been held for productive use in a trade or buisness or as an investment. Examples of “like kind” are; residential, commercial, raw or bare land and TIC (tenant in common). An exchangor can not sell a rental property and purchase a primary or second home and qualify for 1031 tax treatment.
